Kamala Harris was just picked as the VP Nominee. But concurrently with this, new information about her California AG actions have come to light.<br /><br />2. Work with me here, this will all wrap up in the end. Gun Owners of California just filed an Amicus Brief in the Rhodes v. Becerra case - which challenges the ammo background check.<br /><br />3. The brief analyzes the AG’s claims that background checks work, despite this being an even weaker background check than is currently in place that allegedly prohibits criminals from getting the firearms that they now need the ammo for.<br /><br />4. The brief whittles down the more than 100k denials to reveal that only 760 denials have been based upon the person being “allegedly prohibited.”<br /><br />5. Of those, another 16 were ultimately approved.<br /><br />6. But this is where it gets good. Of those 744 remaining denials for allegedly being prohibited persons, their denials were based upon the California Criminal History databases. The Brief cites a recent study in which it states that nearly half the arrest records lack dispositions.<br /><br />7. The brief also cites an older Los Angeles Times article that substantiates that this issue of having nearly half of the records be incomplete has been known since 2011.<br /><br />8. Thus, even assuming the the DOJ interpretations of the records is accurate, its based on a database that is half complete. So each potential purchase has the odds of a flip of the coin.<br /><br />9. But that is assuming that the DOJ as the gatekeepers of a fundamental right are acting in accordance with the constitution.
