Night watchman testifies Frank warned him they would both suffer if he kept claiming innocence
Newt Lee followed Detective Black on the stand.
Asked to tell the jury about his private conversation with Frank, Lee gave the following account. He was sitting in the room when Frank came in. Lee told Frank it was hard to be sitting there in handcuffs. Frank replied that he believed Lee was innocent. Lee said he told Frank he knew nothing beyond finding the body.
"Yes," Lee testified Frank then said, "and you keep that up and we will both go to hell!"
Lee told Frank that if the girl had been killed in the basement, he would have known about it. Frank's response, according to Lee, was: "Don't let's talk about that. Let that go!"
Frank has stated that detectives instructed him precisely what to say to Lee in an effort to get him to talk, and that he said what he was told.
Never Met Him Before
Lee confirmed that the furnace had been fired up on Saturday night. He also described an unusual exchange when he arrived at the factory that evening. Frank came out to meet him at the door, rubbing his hands together, and told Lee he was sorry he had asked him to come in so early when he might have been sleeping. Lee replied that he could use the sleep.
Asked whether Frank had ever come out to meet him before, Lee said no. The usual routine, he explained, was that Lee would say "All right, Mr. Frank," and Frank would simply reply "All right."
Lee said the trap door was normally left open in the evenings when he arrived. He noticed nothing on the floor of the machinery room when he went in.
Sure He Punched Clock
Describing what happened when he arrived at 6 o'clock, Lee said Frank came out and asked him the time, then told him not to punch the clock because he wanted to put on a new tape. Lee held the lever while Frank installed it. Asked whether Frank had unlocked the clock door, Lee said no, Frank simply opened it.
Lee stated that he was certain he had punched the clock every half hour throughout the night.
Regarding the shirt found at his home, Lee said it looked like one of his and that he used to have one like it. As for the clothes found in the barrel, he said his were stored there and that the woman of the house may have kept some of hers there as well. Asked whether the shirt was store bought, Lee said it was not, stating that a Mrs. John Bowen had made it for him.

L'information est tombée. Le 6 mai 2026, la Cour pénale neuchâteloise en Suisse a condamné Idriss Aberkane à 24 mois de prison avec sursis. En première instance, il n'avait écopé que d'une peine pécuniaire. Ce durcissement soudain, atteignant le maximum légal pour cette procédure, soulève de graves questions sur l'impartialité du traitement réservé au conférencier.
Tout porte à croire que nous assistons à une manœuvre visant à neutraliser une figure médiatique trop influente. Idriss Aberkane dérange par sa capacité à éveiller les consciences sur des sujets sensibles. Face à l'impossibilité de le contrer sur le terrain des idées, la machine judiciaire semble prendre le relais pour briser l'homme et sa réputation.
La riposte ne s'est pas fait attendre. Idriss Aberkane s'est constitué Partie Civile à Paris pour escroquerie au jugement et faux en écriture publique en bande organisée. Cette plainte vise directement le Procureur Général du Canton, Pierre Aubert. Selon toute vraisemblance, la bataille ne fait que commencer entre la dissidence et un appareil d'État déterminé à maintenir son hégémonie.
Sommes-nous face au crépuscule de la liberté de penser en Europe ? L'acharnement contre Aberkane n'est-il que le prélude d'une répression plus vaste contre toute alternative au récit officiel ? La justice peut-elle encore être souveraine lorsqu'elle s'attaque avec une telle virulence à ceux qui osent sortir du cadre imposé par la caste ?

Night watchman also recalled to stand; inquest expected to go to jury by 7 o'clock
Leo M. Frank, superintendent of the National Pencil Factory, and Newt Lee, the night watchman, were both recalled to the witness stand late Thursday afternoon at the coroner's inquest. Both men are being held in connection with the inquiry into the death of Mary Phagan.
Frank was subjected to a more searching examination of his movements on the day of the tragedy than he had faced during his first appearance on the stand. An apparent effort was made to demonstrate that he was not at home at the times he had stated in his earlier testimony. Frank, however, answered the questions readily, and Coroner Donehoo was unable to catch him in a contradiction.
It also emerged that in his previous testimony Frank had failed to mention several people who were at his home on Saturday night. When pressed on this point Thursday afternoon, he supplied their names without hesitation.
Frank was brought into the Commissioner's Room at the police station before the inquest began but was later excused while Rogers was called. The factory superintendent was pale but calm and composed. He whispered briefly to his counsel, Luther Z. Rosser, and managed a faint smile at a remark directed at him. He appeared to be showing the strain of the days he had spent in a cell.
Newt Lee Preceded Frank on the Stand
Lee's testimony centered on the private conversation he had with Frank following his arrest. He declared that Frank had warned him they would both "go to hell" if they were not careful. The weight of this testimony was largely undercut, however, by Frank's earlier statement that the remark, or one to the same effect, had been suggested to him by detectives in the hope of drawing information out of the night watchman.
Lee was not admitted to the hearing room at the outset but was held in a nearby office. The night watchman appeared nearly indifferent to the proceedings.
Morning Session Not Prolific
The morning session produced nothing of consequence. The principal witnesses were "Boots" Rogers, the former county policeman, and Lemmie Quinn, foreman of the tipping department at the National Pencil Factory. Neither offered testimony that pointed suspicion in any particular direction against Frank or Lee.
Rogers was questioned closely about the morning the crime was discovered and described bringing officers to the scene in his automobile. Beyond his impression that Frank appeared nervous when detectives visited him at home, he had nothing that clearly implicated anyone. He did state with certainty, however, that the time clock tape showing Newt Lee's half hour rounds had no missed punches when Frank removed it from the clock that morning. A tape later brought to police headquarters showed three such misses.
An effort was made to break down Quinn's account that he had visited the factory and spoken with Frank between 12:10 and 12:20 on the Saturday afternoon of the murder. Coroner Donehoo attempted to get Quinn to admit that he had previously told officers he had not been at the factory between Friday and the following Sunday. Quinn steadfastly refused to concede any such statement and maintained that he had briefly visited Frank's office that day, supporting Frank's own testimony from the previous Monday.
Miss Hattie Hall, the stenographer present at the factory office until noon on Saturday, also testified during the morning session regarding Frank's movements while she was there.
Inquest Near End
Miss Hattie Hall and Herbert Schiff, the pencil factory's chief clerk, were the first witnesses of the afternoon session.
New testimony along a previously unexplored line is expected from Miss Nellie Wood of 8 Corput Street, Miss Nellie Pettis of 9 Oliver Street, and Mrs. Lilie Pettis, also of 9 Oliver Street. All three young women are understood to assert that Frank sought to treat them in a familiar manner.
One additional witness, a young woman whose name authorities have declined to reveal, is expected to provide the concluding testimony. She is reported to be ill but will appear with her physician.
Newt Lee took the stand at 4:10 o'clock, called by Coroner Donehoo immediately after Detective John Black completed his testimony, which supplemented the earlier evidence given by Pinkerton Detective Harry Scott.
Officials stated that they were satisfied with the progress of the case and predicted the matter would be placed in the hands of the coroner's jury for a verdict by 7 o'clock.

Witnesses Are Quizzed in Detail, but Nothing Important Brought Out. Officials Say They Are Satisfied With Case as It Is Being Developed.
Whatever evidence the police officials may have directly to connect any of the suspects with the killing of Mary Phagan, it was not produced at the early session of the Coroner's inquest Thursday.
What this evidence is the officials refuse to say—except that they are satisfied with the progress that is being made in unraveling the mystery.
Leo Frank, superintendent of the National Pencil Factory, is expected to be the most important witness of the day.
It is said that an entirely new line of questioning will be taken up.
W. W. ("Boots") Rogers, former county policeman, and Lemmie Quinn, foreman in the tipping department at the National Pencil Factory, were the principal witnesses. Neither gave testimony that was materially damaging to either Leo M. Frank or Newt Lee, who are being held in connection with the crime.
Rogers was questioned closely of the events of the morning the crime was discovered, and told of taking the officers to the scene in his automobile. Beyond his belief that Frank appeared nervous when he was visited at his home by the detectives, Rogers had no information that appeared to point suspicion in one direction more than another.
He was sure, however, that the time clock tape on which Newt Lee, the night watchman, registered his half-hour rounds of the factory had no "misses" when it was taken from the clock by Frank that morning. Three misses were found on a tape subsequently brought to Police Headquarters.
Quinn's Story Unchanged.
An effort was made without avail to break down the story of Lemmie Quinn that he was at the factory and talked to Frank between 12:10 and 12:20 the Saturday afternoon of the tragedy. Coroner Donehoo tried to get Quinn to admit that he previously had told officers who interviewed him that he was not at the factory between Friday and the following Sunday.
Quinn steadfastly refused to admit that he had made a statement of the sort. He supported Frank's testimony of last Monday by insisting that he visited the factory for a few minutes and went into Frank's office.
Miss Hattie Hall, the stenographer who was at the factory office Saturday until noon, was another of the witnesses called to the stand during the forenoon. She testified as to Frank's movements while she was there.
Frank Pale, but Calm.
Frank was brought into the Commissioner's Room in the police station before the inquest began, but later was excused and Rogers called.
The factory superintendent was pale, but calm and collected. He whispered a few words to his counsel, Luther Z. Rosser, and smiled faintly at a remark that was made to him. He appeared to show the strain of the days since he has been in a cell.
Lee was not admitted to the room at the beginning of the hearing, but was detained in a nearby office. The night watchman seemed almost indifferent.

He was certain, however, that the time clock tape recording Newt Lee's half hour rounds showed no missed punches when Frank removed it from the clock that morning. A tape subsequently brought to police headquarters showed three such misses.

Le cessez-le-feu annoncé entre l’Iran, Israël et les États-Unis donne l’illusion d’un apaisement. En réalité, il ressemble surtout à une suspension précaire des hostilités, pas à une sortie de crise. Les faits vont dans ce sens : les discussions n’ont pas produit de règlement de fond, les désaccords sur le nucléaire, les sanctions, la sécurité régionale et la liberté de circulation dans le détroit d’Ormuz restent entiers, et plusieurs responsables internationaux décrivent la trêve comme extrêmement fragile.
Pourquoi parler d’illusion ? Parce qu’un vrai cessez-le-feu suppose un cadre clair, des garanties, un mécanisme de contrôle et une volonté politique commune. Or ici, rien de tout cela n’est solidement établi. Les États-Unis maintiennent une ligne dure sur le programme nucléaire iranien, tandis que Téhéran exige des contreparties majeures, notamment sur les sanctions et les garanties de non-agression. Tant que ces points restent bloqués, la trêve demeure un simple entre-deux, susceptible de voler en éclats au moindre incident.
Cette illusion tient aussi au fait que la guerre ne s’est pas vraiment arrêtée dans l’environnement régional. Même lorsque certains fronts ralentissent, d’autres continuent de s’embraser, en particulier au Liban et à Gaza. Autrement dit, on parle de cessez-le-feu alors que la dynamique générale de confrontation reste intacte. Une paix partielle dans une région toujours en feu n’est pas une paix : c’est une pause tactique.
Il faut également voir que chacun cherche à transformer cette trêve en victoire politique de communication. Washington veut montrer qu’il garde l’initiative. Israël veut sauver l’image d’une supériorité stratégique. L’Iran veut prouver qu’il a encaissé le choc sans céder sur l’essentiel. Quand chaque camp vend un récit de victoire à son opinion, cela signifie souvent que personne n’a réellement réglé le conflit.
Au fond, ce cessez-le-feu n’efface ni les causes du conflit, ni les objectifs contradictoires des puissances impliquées. Il ne met pas fin à la logique d’escalade, il la suspend temporairement. Et tant que les questions centrales restent ouvertes, cette trêve ne sera pas la paix, mais le simple intervalle entre deux poussées de fièvre.

I wanted to share some things that I witnessed in 2012.
I wanted to turn the subject to the Occupy Movement.
Wikipedia states: “The Occupy movement was an international populist socio-political movement that expressed opposition to social and economic inequality and to the perceived lack of real democracy around the world. It aimed primarily to advance social and economic justice and different forms of democracy.”
I joined the Occupy Movement in Albuquerque between the end of 2011 to the beginning to 2012. When I joined the Occupy movement in Albuquerque, the Albuquerque branch was in the beginning of changing the name to “Un-Occupy”.
“un)Occupy Albuquerque, in solidarity with the Occupy Wall Street movement, indigenous peoples, and colonized peoples worldwide, realizes that language has historically played a powerful role in social transformation. Given the “occupation” of native lands across the Americas since 1492, the colonization of Africa, Asia, and other parts of the world, and the continued “occupation” of Iraq and Afghanistan, we resist the term “occupy” or, for that matter, any language that is connected to the oppression of people.”
The group decided to change the name to Un-Occupy, and it was about two weeks or one week, even days after this decision that I joined the movement, and began attending the rallies.
I attended the Un-Occupy gatherings in 2012.These are some of the people I saw and heard and agreed with, I was right next to them when this person recorded this footage:
I agreed with these two people, and what they were saying, too.I also agreed with the change of the name "Occupy" to "Un-Occupy".
I wanted to say that neither me or any other protestor did anything wrong to warrant attention from law enforcement or police. Footage like this proves such. The Occupiers and Un-Occupiers are great, peaceful people with peaceful ideas. I became more involved in the movement after hearing the speeches from these two women.
Along with protests at the center of the un-occupy gatherings, I also attended a free Leonard Peltier march as well.These are links to the hand signs, that we used at the Un-Occupy gatherings.
We also discussed the use of the "feather" used at Rainbow gatherings, but mainly stuck to the Occupy Wall street hand signs. They are in the links above : )
I witnessed a lot of harassment of the Occupiers and Un-Occupiers by the police. I narrowly escaped arrest, and helped others escape arrest, at several points, during several marches. There were nationwide abuses at the hands of police that occurred at that time, that I was also a victim of.
For 06 months, police harassed me wherever I parked my home, a volkswagen westphalia camper van. After weeks of harassment, the police found an excuse to arrest me and they stole my car at this time.
I hid out in Taos for awhile - I continued to play live shows on my guitar through parts of the time I spent camping in tents.
After I returned to "Civilization" in 2014, I had the displeasure of witnessing the gestapo that stole my car, murder more than 3 innocent people, one of whom was a fellow homeless man camping in the Manzano mountain area.
The preceeding was an explanation of why I went missing for 2-3 years. It mainly concerns the period of time between 2011 and 2016.

Metal department foreman testifies he visited factory around 12:20 on day of murder and found Frank alone in office
L. A. Quinn, foreman of the metal department at the National Pencil Factory, the department in which Mary Phagan worked, was called to the stand and testified as follows.
Quinn confirmed that he knew Mary Phagan and that she worked in his department alongside other girls as well as Henry Smith and John Ramey, all working together in the same room. The last time he saw her was the Monday before the murder. He left the factory on Friday and was not due back until Monday morning.
He rose at 7 o'clock Saturday morning. He and his wife went uptown to have their baby's photograph taken, leaving home at 9:30 and reaching the photographer's at 10. They came back down Whitehall Street, stopped at the Globe Clothing store to talk with friends, continued to a meat market where they spent about five minutes, then stopped at a soda fountain before returning home at 11:15. Quinn left again at 11:45, heading to a meat market, then to a soda fountain at Benjamin's Pharmacy where he bought two cigars. It was a few minutes after noon at that point. He then walked to the National Pencil Company.
His purpose in going, he said, was to speak with Mr. Schiff. He did not see Mary Phagan. He estimated his arrival at around 12:20.
Spoke to Frank
The only person he found in the office was Mr. Frank. Quinn greeted him and stayed approximately two minutes. He placed his arrival somewhere between 12:15 and 12:30, but when asked whether it could have been as late as 12:30, he said no. Asked how he could be certain, he replied that he was somewhere else at 12:30.
Upon leaving the factory he ran into Mr. Malsby outside, who told him that the girls, meaning Mrs. Freeman and Miss Corinthia Hall, were in the Busy Bee Café at Hunter and Forsyth Streets. Quinn went to the café, found Miss Hall and Mrs. Freeman there, and stayed about two minutes before all three left together. The women went to Malsby's to use the telephone.
Went to Pool Hall Then
Quinn went to DeToro Brothers pool parlors, arriving at 12:30 and staying until 1:15. He then went to the Atlanta Theater, arriving around 1:20. He estimated the walk from his home to the factory at between twelve and fifteen minutes.
He described Frank as wearing a brown suit when he saw him at the factory. On Sunday, Quinn met with Mr. Darley and Mr. Montague at 9:30 and went with them into the basement with a lantern. He later saw Frank at Bloomfield's on Sunday afternoon, dressed in what appeared to be a black or blue suit. Frank said nothing beyond hello.
Refreshed Frank's Memory
Quinn flatly denied telling any officer that he had not been at the factory since Friday. He denied saying so to Officer Payne and denied saying it to Detective Starnes.
He told the coroner that after Frank had been locked up, he had visited him and brought up his Saturday presence at the factory. The subject arose while the two were discussing the theory that Mary Phagan had never left the building. Quinn told Frank: "Why, I was there Saturday after the time you say Mary Phagan was." Frank said he remembered Quinn being there but was not certain of the time. Quinn told him what time it was. Frank said he would mention it to his lawyers. Quinn said he told Frank he did not want to be drawn into the case but would come forward if it would help him.
He confirmed he was alone with Frank during this conversation.
Questioned of Talk With Girl
Quinn was questioned closely about any conversation he might have had with Grace Jones, one of the factory girls. He denied discussing the murder with her at all and denied ever saying he had not been at the factory on Saturday.
He had visited the Coleman home after the murder, he said, but did not discuss Frank's habit of fixing the machines with them. He had not told a factory worker named Barrett that he had been at the factory on Saturday.
Tells How He Is Paid
The first person he told about his Saturday visit was his father, he said. He later told Chief Lanford. His pay continued during the days he was away from the factory, as it had on other occasions since becoming foreman. He is paid by the week.
Asked why he had gone to Frank with the information rather than to the detectives, Quinn was direct.
"I knew he wouldn't question me three or four hours like the officers would."
When pressed on his duty toward helping solve the mystery, Quinn said he assumed that if the officers were conducting a thorough investigation they would certainly come to him, as he was the foreman of the metal department.
"I knew they had three or four men locked up," he said, "and as I had been in the building they might lock me up, too
